It all started Seven years ago

We purchased the New South Wales business off another party and transferred the lease and that was the start of our problems. What we didn't realise was;

It was not fire compliant and had not been inspected for years. What that means is if there had been a fire our insurance could have used that as an out. It took five years to make it fire compliant.

Another business was using our unit number.

People could not find us as our street address was on  Longueville Rd and or enterance on Birdwood Lane. This also meant that if an emergency service was called there could be a delay in finding us and it could also be used as an out for insurance.

All of the above was not in the disclosure statement, nor was the landlord's contact details, something a law firm has said on their website is a requirement.

It took the agent more than a year and a half to deposit the bond money with the Department of Fair Trading when it is a legal requirement to do so without delay.

A year or so latter we took up a five year option on the lease not been aware of the above problems.

All this was a surprise to us and we only only found out about it too late. When we spoke to the agent they had a bit of a chuckle and told us the landlord was aware of the problems with finding us and someone else using our unit number, but did nothing about it.

The noise

The place is operated as a beauty salon Xara Skin Clinic and as so there should not be lots of noise and we should be able to enjoy in peace. That didn't happen we had a constructions site across the road from us for two and a half years. The shop below us closed down and we had three months of noise from the fitting been stripped. We had repairs on the roof that seemed to take two months. Then after almost four years of the shop below been empty and up for lease we had another three months of noise from the fitout.

The ground floor shop was rented out for $600 per week yet they put our rent up stating it was market rent. The owner of that shop would have lost more than $125k as there was a three months free fit out period on top of the lost rent. Hey we are on the second floor and as such our rent should be cheaper? Don't you think so?

Nothing gets fixed yet we pay our rent

Then we had the render fall off the building next door, not a small piece but I would estimate 20 sqm, which was minutes away from crushing the Xara Skin Clinic manager. It damaged the air con, there was a was a work order put out months ago yet no sign of anything getting done. Did the agent or stata offer assistance, there really wasn't any service, or care and we couldn't get the building owners contact details, we spent hours on it.

The beauty skin clinic sign was the only thing holding the facade on to the building as there was a risk it could fall off injuring someone. It took two years to get that fixed, but it looks like new.

There was a sink that was detached from to drain pipe cause a smell to come from it. It was reported as a health hazard, you guessed it two years to get that fixed. Come on this is Australia, not a third world location.

Birdwood lane

I spoke to the council about the problem with people finding us without directions. They said they were aware of the issue and all we had to do was fill out a form, pay $40 and they would give us an additional address. We did that and sent the form to the agent months ago and nothing happened, we even gave our account details so we would have paid for it.

Renewing the lease

In July 2021 we sent an email to the agent stating we would like to take up the five year option on the lease, we got a response back from the agent acknowledging it. A few weeks latter we got a document emailed to us which we printed off, signed and returned. This was done by two of us, so we both saw the documents. Months latter the agent said she didn't have a record of it and we got a vacate notice from a lawyer, signed by a Margaret Joan Crane and Philip Frederick Crane. If anyone can help us out, Margaret Joan Crane and Philip Frederick Crane or has details on other properties they own, help us out and we can help others. When I spoke to the lawyer, I said that we were happy to enter negotiations to purchase the property, nothing back.

The landlord

We have leased the skin shop for the last seven years, has the landlord once contacted us? No they haven't once come out from under a rock. They just hide behind others and let them do or not do their dirty work

Why am I writing this? We didn't want others to that our beauty skin business has gone through. If we can stop businesses from taking out leases with Spirarze Pty Ltd ACN 003566970, we would have done them a service. Lane Cove NSW New South Wales.
